Terms of Service

Last Updated: August 2026

1. Introduction

Welcome to Tilliza Point of Sale (POS), a product of danaleko.com ("we," "our," or "us"). By purchasing, installing, or using the Tilliza POS software, you ("the Client," "you") agree to be bound by these Terms of Service.

2. Software License & One-Time Payment Model

Tilliza POS is sold as a one-time purchase, non-SaaS (Software as a Service) product. Upon payment of the one-time fee associated with your selected package, danaleko.com grants you a perpetual, non-exclusive, non-transferable license to use the software.

Your license usage and available features are strictly limited by the tier you purchased:

  • Starter License (KSH 30,000): Limited to a maximum of 2 users and 1 physical store location. Includes core features such as offline-first reliability, direct thermal printing, and global barcode scanning.
  • Professional License (KSH 70,000): Limited to a maximum of 30 users and up to 10 store locations. Includes advanced features such as centralized multi-branch sync, remote admin dashboards, and automated reporting.
  • Custom Solution: Built for unique scale. Provides unlimited users and locations, custom software/hardware integrations, and optional on-premise deployment. Terms, pricing, and scope are defined in a separate, custom Service Level Agreement (SLA).

You may not resell, redistribute, sub-license, or reverse-engineer the Tilliza POS software.

3. Purchasing, Installation, and Setup

Because Tilliza is a comprehensive retail solution, access to the software is provisioned through a guided onboarding process rather than an automated download:

  • Scheduling: Upon successful selection and payment of your chosen plan, our team will contact you to schedule an official Installation, Setup, and Training session. (Custom Solution clients will be assigned a Dedicated Account Manager).
  • Installation: Our technicians will assist in installing and configuring the software on your designated retail devices.
  • Setup: We will assist with the initial configuration of your store, including bulk importing your existing product inventory (via CSV), setting up tax parameters, and configuring employee roles.
  • Training: A dedicated training session will be provided to ensure you and your staff understand how to process sales, manage the cash drawer, and track inventory.

4. Client Responsibilities During Setup

To ensure a smooth installation process, the Client agrees to:

  • Provide compatible computer hardware (laptops, desktops, or tablets) that meet our minimum system requirements.
  • Have all necessary retail hardware (thermal receipt printers, barcode scanners, cash drawers) available on-site during the scheduled setup.
  • Provide a clean, formatted CSV file of current inventory for the bulk import process.

5. Support and Maintenance

Your one-time purchase includes the software license for life. It also includes standard technical support and software updates for a period of one (1) year from the date of installation.

  • After the one-year period, your Tilliza POS software will continue to function fully with no monthly fees.
  • However, continued access to dedicated customer support, advanced troubleshooting, or major future feature upgrades may require the purchase of an optional annual maintenance package.

6. Data Ownership and Backups

  • Offline Functionality: Tilliza POS is built with offline-first reliability. Data processed while offline is stored locally on your device. You are solely responsible for securing and physically backing up the device hardware.
  • Cloud Syncing & On-Premise: If you are utilizing our Professional multi-branch/cloud-sync features, your data is securely mirrored to our servers. Custom Solution clients may opt for full on-premise deployment. In all cases, you retain 100% ownership of your business data.

7. Hardware Compatibility

Tilliza utilizes modern browser technologies (such as WebUSB) to communicate directly with hardware like thermal printers and barcode scanners. While we strive to support industry-standard hardware, danaleko.com does not guarantee compatibility with every third-party hardware brand unless specifically contracted under a Custom Solution tier. Our team will verify hardware compatibility during your scheduled setup.

8. Limitation of Liability

To the maximum extent permitted by applicable law, danaleko.com and Tilliza shall not be liable for any indirect, incidental, special, or consequential damages. This includes, but is not limited to: loss of profits, loss of data, business interruption, hardware failure, or accounting discrepancies. The software provides reporting and calculation tools, but the Client is ultimately responsible for verifying all financial, inventory, and tax data. In no event shall our total liability exceed the one-time fee you paid for the software license.

9. Termination

We reserve the right to terminate your license immediately and without refund if you are found to be bypassing license limits (e.g., using a Starter license for 10 locations), distributing unauthorized copies of the software, attempting to hack the authentication system, or otherwise violating these terms.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
